FAQs

Common questions about LLC tax returns

Is my single-member LLC reported on my personal return?
By default yes — on Schedule C (active trade/business) or Schedule E (rental activity). Check-the-box elections (Form 8832) can change that to partnership or corporate treatment.
Do I pay self-employment tax on LLC profits?
US-resident members typically yes (Schedule SE — 15.3%). UK-resident members covered by the US-UK Totalisation Agreement usually no, provided you hold a Certificate of Coverage from HMRC.
What about state franchise taxes?
Most US states charge an LLC filing fee or franchise tax. California's $800 minimum catches everyone; Delaware has a $300 franchise tax. State rules vary widely and add complexity for multi-state LLCs.
Can my UK partner receive K-1s from a US LLC?
Yes if the LLC is taxed as a partnership. The UK partner would also file 1040NR or have tax withheld via Form 8804/8805 depending on income character. Cross-border LLCs need coordinated US/UK reporting.
